Proposed Legislation Would Allow Probationers To Use Drugs, Alcohol

On Thursday morning FSU was sent the PDF below.  The sender wanted to point out the following:”It appears Senator Pinkney is going to introduce a bill that removes much of the authority of the court and the DOC to handle those offenders sentenced to probation.  The bill was drafted without input from the DOC or the Probation Officers Union.  The bill even goes so far as saying use of drugs is ok as long as it isn’t related to the crime they’re convicted of.”

The language regarding that change can be found at the bottom of page 4.

(4) A court or the Department may not prohibit a probationer from using or possessing alcohol or drugs, or require probationer to be subject to testing for alcohol or drug use, unless the use or possession of alcohol or drugs is reasonably related to the probationer’s crime of conviction.
