Delaware State Police arrested 36-year-old Kevin Clary of Millsboro, for an attempted robbery and felony assault that occurred yesterday afternoon in Rehoboth Beach.
Officials said the incident occurred Friday afternoon at around 3:30, at the Wendy’s located at 19054 Coastal Highway.
Authorities became involved when a trooper was approached by a 38-year-old man who was stabbed in his hand. Troopers learned that the victim was in the passenger seat of a car in the parking lot of Wendy’s when he was approached by an acquaintance, identified as Clary.
Clary had been inside the Wendy’s when he discovered the victim was in the parking lot and made statements about killing the victim before he went outside according to police. Once outside, Clary opened the victim’s car door, demanded money from him, and repeatedly jabbed at him with a knife while making statements about killing him police said. The victim was able to close his door to stop Clary’s assault; at which point, Clary began kicking the door until the victim’s girlfriend returned to the car and drove to the trooper at a nearby business.
The victim was taken to an area hospital by ambulance for his injury. Responding troopers located Clary near a wooded area on Coastal Highway and took him into custody without incident.
Following his arrest, Clary was transported to Troop 7 for processing. He faces several charges, including Attempted Robbery First Degree, Assault First Degree, Possession of a Deadly Weapon During the Commission of a Felony, Possession of a Deadly Weapon by a Person Prohibited, Terroristic Threatening, Possession of Drug Paraphernalia, and Disorderly Conduct. Clary was arraigned at the Justice of the Peace Court 3 and is currently held at the Sussex Correctional Institution with a cash bond set at $64,300.
