Smyrna– The Delaware State Police have arrested a Wilmington man after a traffic stop led to the discovery of a handgun, according to Public Information Officer, Master Corporal Melissa Jaffe.
Jaffe said the incident occurred on Thursday, July 5, 2018, at approximately 2:31 p.m. when a Trooper observed a 2003 Mercury Sable traveling above the posted speed limit on northbound Route 13 in the area of Hickory Ridge Road.
A traffic stop was initiated and contact was made with the driver and two occupants. Further investigation revealed that the 29-year-old male operator from Dover had a suspended driver’s license and an active capias, according to Jaffe.
Upon contact with the occupants, a “blunt” containing marijuana was observed inside the vehicle, said Jaffe. Upon identification of the rear seat passenger, it was discovered that he had two active capiases.
A further search of the vehicle led to the discovery of a handgun located in a compartment in the glove box with an obliterated serial number, added Jaffe.
The rear seat passenger, identified as Lawrence D. Baily was transported back to Troop 9 where he was charged with Possession of a Firearm by Person Previously Convicted of A Violent Felony, Possession of a Weapon with an Obliterated Serial Number, Carrying a Concealed Deadly Weapon, and Possession of Marijuana.
Baily was arraigned before the Justice of the Peace Court 7 and committed to the James T. Vaughn Correctional Center on a total of $79, 647.22 secured bond for his current charges and two active capiases.
The driver was released after being issued a citation for speeding and other traffic-related offenses.
The front seat passenger, a 28-year-old male from Philadelphia was not charged.
