The workers left and drove to a construction site on North Bay Drive, where they saw Swain approach them while yelling and brandishing a firearm, and then he shot at them according to police. The victims were not injured.

Swain was arrested and taken to Troop 3, where he was charged with two counts of Reckless Endangering (Felony) and Possession of a Firearm During the Commission of a Felony (Felony). He was arraigned by Justice of the Peace Court 7 and committed to Sussex Correctional Institution on a $25,000 cash bond.
