Police: Caught In The Act, Released On Unsecured Bond

The Delaware State Police made two arrests early Monday morning, in Wilmington, for a felony theft incident.

Officials said the suspects, identified as 48-year-old Michael Napolitano (Right) and 60-year-old Ronald Ruthardt (Lefty), both residents of Wilmington, were apprehended after being caught stealing parts from air conditioning units at an office building on the 2900 block of Concord Pike.

At approximately 2:12 a.m., troopers responded to a report of theft in progress at the office building. Upon arrival, law enforcement officers witnessed Napolitano and Ruthardt dismantling an air conditioning unit according to police. As soon as the suspects noticed the presence of the troopers, Napolitano attempted to evade capture and fled the scene on foot, while Ruthardt remained behind and was promptly taken into custody.

A thorough search of the area was conducted by troopers and K9 Chico, resulting in the discovery of Napolitano hiding in a nearby neighborhood behind the business. He was apprehended without incident.

Following their arrests, both Napolitano and Ruthardt were transported to Troop 1 for processing. They have been charged with multiple offenses related to the theft, including Theft Over $1,500, which is classified as a felony, Criminal Mischief (Felony), Conspiracy Second Degree (Felony), and Criminal Trespass Second Degree. Additionally, Napolitano faces an additional charge of Resisting Arrest.

Both suspects were arraigned at Justice of the Peace Court 2. Napolitano was released on a $4,500 unsecured bond, while Ruthardt was released on a $3,500 unsecured bond.

An unsecured bond means that the suspects are not required to pay the amount upfront but will be held liable for it if they fail to appear for subsequent court proceedings.
